Terms of Service

 

1. General Provisions
These General Terms and Conditions for online sales have been prepared in accordance with the Slovenian Consumer Protection Act (ZVPot-1) and the Slovenian Weapons Act (ZOro-1). The Webshop is operated by Max Airsoft d.o.o., Opekarniška 15d, 3000 Celje, Slovenia (hereinafter "Provider").

 

2. Compliance with the Slovenian Weapons Act (ZOro-1)
The Provider strictly adheres to the regulations of the Republic of Slovenia regarding the sale of weapons, weapon parts, and ammunition.

  • Firearms (Lethal Weapons): Firearms and regulated weapon parts categorized under ZOro-1 cannot be purchased online for home delivery. These items are displayed on the website for informational purposes only. Purchase and pickup are only possible in person at our physical store in Celje, upon presentation of a valid identity document and the required purchase permit issued by the competent authority.
  • Air Weapons (Category D): Certain products and airguns are restricted to persons over 18 years of age. The Provider requires age verification (ID copy) before shipping.
  • Weapon Accessories: Accessories that are not legally regulated as essential weapon parts (e.g., optics, grips, holsters, non-regulated tactical gear) can be purchased online and shipped via courier service.

 

3. Age and Identity Verification
For any restricted items (Category D airguns, ...):

  • Mandatory Identification: The Provider requires proof of age (18+) before processing the order. The Buyer may be asked to provide a copy of a valid government-issued ID.
  • Cancellation: If proof of age is not provided or is invalid, the order will be cancelled and any payments refunded, minus administrative costs.

 

4. International Buyers and Local Legislation (EU & Worldwide)
The Provider operates exclusively under the laws of the Republic of Slovenia.

  • Buyer’s Sole Responsibility: Regulations for airsoft, airguns, and weapon accessories (e.g., laser sights, high-capacity magazines, muzzle energy limits) vary significantly across the EU and globally.
  • Compliance Check: By placing an order, the Buyer explicitly confirms that the ordered items are legal to possess and import in their country of residence.
  • Liability & Seizure: The Provider shall not be held liable for any legal consequences, customs seizures, or fines in the destination country. No refunds will be issued for items confiscated or destroyed by foreign authorities due to non-compliance with local laws.

 

5. Prices, VAT and Payment

  • VAT Rates: In accordance with EU regulations (OSS), VAT is charged based on the VAT rate of the destination country where the package is being shipped.
  • All prices displayed include the applicable VAT. Prices are valid at the moment of order confirmation.
  • Payment methods: Credit Card (Visa, Mastercard, Diners) or Bank Transfer.

 

6. Shipping and Free Delivery Thresholds
Delivery is provided via courier services. Free shipping applies to orders exceeding the following values:

  • 40€: Slovenia
  • 80€: Croatia, Austria, Hungary, Slovakia, Czech Republic, Poland, Romania, Bulgaria
  • 100€: Germany, Belgium, Netherlands, Estonia, Denmark
  • 120€: Lithuania, Latvia, Italy, Greece, France, Spain
  • 150€: Portugal, Ireland, Sweden, Finland

Damage: Buyers must inspect packages upon receipt. If damage is visible, reject the shipment and request a formal record from the courier. Claims must be filed within 14 days.

 

7. Right of Withdrawal and Returns
The Buyer has the right to withdraw from the contract and return the goods under the following conditions:

  • Deadline: A withdrawal or exchange is possible within 14 days of receiving the items. Items must be returned to our address within 14 days after the withdrawal notice has been submitted.
  • Condition of Goods: To be eligible for a full refund, items must be unused, undamaged, and in their original packaging.
  • Packaging: The original packaging is considered an integral part of the product and must be undamaged. Please do not use the original product box as the outer shipping container and avoid applying tape or labels directly onto it.
  • Required Documentation: Returns must include the original invoice, warranty card, the full contents of the shipment, and a completed return/exchange form.
  • Exclusions: Please note that modified items and items made to order (custom orders) cannot be returned or exchanged.
  • Return Address: MAX AIRSOFT d.o.o., Opekarniška cesta 15D, 3000 Celje, Slovenia.
  • Costs: Shipping costs for returning the goods are covered by the Buyer. We do not accept "cash on delivery" (collect on delivery) return shipments. For your safety, we recommend using a trackable shipping service.
  • Refund: The full purchase price for the items will be refunded within 14 days of our receipt of the returned goods.

 

8. Warranty and Service
Standard warranty repair period is 30 days from the date of receipt. This period may be extended by an additional 15 days if necessary due to technical complexity or parts availability.

 

9. Limitation of Liability
The Provider is not liable for minor technical deviations or symbolic photographs. In case of significant errors in price or description, the Buyer will be notified and may withdraw from the contract.

 

10. Complaints and Disputes
The Provider aims for amicable resolutions. If an agreement is not reached, the competent court in Celje, Slovenia, shall have jurisdiction. Slovenian law applies exclusively.
